Terms and Conditions

§ 1 Scope
These Terms and Conditions apply to all rental agreements for e-bikes and accessories between Velory Bikes, based in Hamburg (hereinafter referred to as "Lessor"), and the customer (hereinafter referred to as "Lessee").
The offer is aimed at both consumers and business clients.
In the event of rentals via partner programmes (e.g. hotels, event agencies), the partner acts as an intermediary. The rental agreement and the resulting usage relationship arise directly between Velory Bikes and the end user (Lessee), incorporating these Terms and Conditions.
§ 2 Identity Verification
The Lessee must be at least 18 years old at the time of rental.
The Lessor is entitled to verify the identity of the Lessee before or during the rental period by presenting an identity document or using digital identification procedures.
§ 3 Terms of Payment & Security Deposit
The rental price is based on the price list valid at the time of booking. The total amount is due immediately upon completion of the booking.
Corporate clients (B2B) / Individual agreements:
Unless otherwise agreed, corporate clients will receive a deposit invoice for 50% of the total amount upon booking, payable immediately upon receipt.
The remaining balance will be invoiced after the end of the rental period and is due within 14 days of the invoice date without deductions.
The Lessor reserves the right to demand a higher deposit or full advance payment for new customers or large orders.
The Lessor reserves the right to demand a reasonable security deposit prior to hand-over as security against loss or damage.
For bookings within the framework of partner agreements, the payment and billing arrangements agreed therein shall take precedence.
In the event of default, the Lessor is entitled to charge default interest at the statutory rate as well as dunning fees.
§ 4 Rental Object & Contactless Hand-over (Delivery)
Unless otherwise agreed, the Lessor will deliver the e-bike on the first day of rental by 09:00 at the latest to the location specified by the Lessee (within the defined delivery area).
The Lessee is obliged to check the bike for obvious defects (e.g. flat tyres, brake function) before starting the journey. If defects are not reported immediately (before the first ride) by photo/message to the Lessor, the bike is deemed to have been accepted free of defects.
§ 5 Use & Due Diligence
The e-bike may only be used on paved paths and roads. Jumps or participation in races are prohibited. The Lessee must observe the maximum permissible total weight of the e-bike (as specified by the manufacturer).
The Lessee must observe the rules of the Road Traffic Act. Riding under the influence of alcohol or drugs is strictly prohibited.
Every time the e-bike is parked, even for short stops, it must be locked with the supplied lock to a fixed, immovable object (e.g. bicycle rack, lamppost, fence). Simply locking it (blocking the wheel) is not sufficient.
Overnight, the e-bike should preferably be stored in locked rooms (hotel bicycle cellar, garage). If this is not possible, it must be locked to a fixed object in a well-lit location.
The battery may only be charged with the original charger supplied by the Lessor. The Lessee must protect the battery from extreme heat and frost. Deep discharge must be avoided.
Commercial subletting or handing over to third parties not named in the agreement is prohibited without consent. For corporate clients, transferring the bike to employees of the company is deemed to be in accordance with the agreement.
§ 6 Contactless Return
Unless otherwise agreed, the Lessee is obliged to park the e-bike at the agreed return location (usually the delivery location) on the last day of rental by 18:00 at the latest.
The e-bike must be securely locked to a fixed object. The Lessee is obliged to terminate the rental via the link provided.
The rental period and the liability of the Lessee only end once the rental is terminated by the Lessee. Without termination, the Lessee remains liable for theft or damage until the bike is actually collected by the Lessor.
§ 7 Cancellation & Extension
Private customers can cancel their booking free of charge up to 24 hours before the start of the rental (09:00 on the first day of rental). In the case of a later cancellation, the full rental price (100%) will be charged.
For corporate clients and bookings of 5 or more e-bikes, the following cancellation fees apply:
Up to 14 days before the start of the rental: free of charge.
13 to 7 days before the start of the rental: 50% of the agreed total rental price.
Less than 7 days before the start of the rental: 100% of the agreed total rental price.
The Lessor is entitled to withdraw from the agreement or decline a booking request for an objectively justified reason, particularly if:
the booking contains only accessories without at least one e-bike;
the rental object is not available due to an unforeseen defect or late return by a previous lessee and no replacement bike can be provided;
force majeure or other circumstances beyond the Lessor's control make fulfillment of the agreement impossible;
the Lessee booked using false details or there is reasonable ground to believe that the use could endanger the smooth operation of business, safety or the reputation of the Lessor. In these cases, the rental price already paid will be refunded immediately; further claims for damages by the Lessee are excluded.
An extension of the rental period requires confirmation by the Lessor (subject to availability).
In the event of late return (after 18:00) without prior arrangement, an additional day's rent plus a processing fee of €25.00 will be charged. If the rental period is exceeded by more than 24 hours without authorization, the Lessor will also file a criminal complaint for misappropriation.
An early return of the rental object before the end of the agreed rental period does not justify a claim for a (pro-rata) refund of the rental price.
§ 8 Lessee's Liability (Damages & Theft)
The Lessee is liable for damage, loss and breaches of contract in accordance with statutory provisions.
Breaches of duty by users/third parties to whom the Lessee permits use are the responsibility of the Lessee.
The Lessee is liable for damage exceeding normal wear and tear in the amount of the repair costs.
If the e-bike was not locked to a fixed object, the Lessee is liable for the full replacement value. If the e-bike was properly locked (proof: key/code + police report) and the Lessee had booked the optional Carefree Package, the excess is waived.
In the event of loss of accessories and attachments, the Lessee is liable for the replacement costs.
In the event of theft or traffic accidents, it is mandatory to inform the police and the Lessor immediately.
Tyre damage is subject to the Lessee's operational risk. In the event of a flat tyre, the Lessee is obliged to return the e-bike to the agreed return location at their own expense.
§ 9 Optional Carefree Package (Reduction of Liability & Breakdown Assistance)
The Lessee has the option to purchase the "Carefree Package" (contractual reduction of liability) upon booking for a daily fee. This package reduces the Lessee's liability for certain damages to the rental object.
In the event of theft of the e-bike or permanently installed parts (e.g. motor), the excess is waived. It is mandatory for this that the e-bike was locked to a fixed object in accordance with § 5, the Lessee can produce the original key/code and has reported the theft to the police immediately.
The Carefree Package covers repair costs (e.g. for display, gears, frame) resulting from unforeseen falls, accidents or vandalism by third parties.
If tyre damage (flat tyre) or a technical defect prevents riding, the Lessor provides free on-site breakdown assistance (within the defined delivery/service area). The Lessor will repair the e-bike on site or provide a replacement bike. Passenger transport by the Lessor is excluded.
Exclusions (No Reduction of Liability): The Carefree Package explicitly does not apply in cases of:
Damage or theft due to intent or gross negligence (e.g. unlocked or insufficiently locked e-bike, riding under the influence).
Loss or theft of loose accessories that are not permanently attached to the bike (e.g. removable batteries, keys, chargers, helmets). The Lessee remains liable for these in full.
Third-party liability damage (damage caused by the Lessee to third parties or foreign property with the e-bike).
Damage due to use contrary to the agreement (e.g. off-road riding, water damage from improper use).
§ 10 GPS Tracking (Emergency Location)
E-bikes may be equipped with GPS technology. The Lessor uses location tracking exclusively in emergencies (e.g. to locate a lost/stolen bike or if the e-bike cannot be found at the return location).
There is no continuous recording of movement data; only the Lessor has access to location data.

§ 11 Lessor's Liability & Technical Defects
The Lessor is not liable for damage caused by improper use, riding errors made by the Lessee or disregard for traffic regulations. Use of the rental object is at the Lessee's own risk, provided there is no intentional or grossly negligent breach of duty by the Lessor.
In the event of technical defects that cannot be attributed to improper handling or external influences (e.g. motor error, battery defect, snapped chain during normal riding), the Lessor will endeavour to provide a replacement or repair on site.
Exclusion: Tyre damage (flat tyres) and damage caused by third parties or accidents do not constitute a technical defect of the rental object. In these cases, there is no claim to free breakdown assistance or a replacement on site from the Lessor.
§ 12 Final Provisions
The laws of the Federal Republic of Germany shall apply.
The place of jurisdiction is Hamburg, provided that the Lessee is a merchant or a legal entity.
Should individual provisions be invalid, the remaining part of the contract shall remain unaffected.
